This Privacy Policy will tell you about how Kforce Inc. and its subsidiaries (collectively “Kforce” or “we”) handle your Personal Information from your use of the website, how we use and protect that information, and what choices you have concerning how such information is used on the website you are viewing, as well as any other Kforce-affiliated websites to which may be linked from this website.

This Privacy Policy applies to both individuals who visit and interact with our website and those who engage with Kforce in the job application or employment process. If you are a website visitor who later applies for employment with Kforce, all sections of this Privacy Policy will apply to you, as you are both a website user and a job applicant.

What Information We Collect and How that Information May Be Collected and Used

Kforce considers “Personal Information” as any information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular candidate or device (“Personal Information”). We process Personal Information for the purposes listed below and as necessary to enter into an employment relationship with you.

Personal Information does not include:

  • Publicly available information from government records;
  • Deidentified or aggregated information; and
  • Information excluded from the California Consumer Privacy Act’s (CCPA) scope.

As a part of the employment or job application process, the following categories of Personal Information may be collected from individuals through the sources and methods described below:

  • Geolocation data. This can include location data collected as part of your use of an issued device or personal device for employment or assignment purposes. Geolocation data may also be collected to detect and prevent fraudulent activity related to assignments and engagements.
  • Identifiers and demographic data. This includes data such as title, full name, gender, contact details, such as home and work address, phone number(s), email address(es), your geographic preferences for the location of employment, proof of eligibility to work and details of any work permit application.
  • Characteristics of Protected Classifications Under California or Federal Law. This includes information such as your race, skin color, national origin, ancestry, religion (includes religious dress and grooming practices), sex/gender, gender identity, gender expression, sexual orientation, marital status, disability (mental and physical including HIV/AIDS, cancer, and genetic characteristics), military or veteran status.
  • Image and voice information. This includes information like ID badge photos, photographs or snapshots taken in the hiring processes, security camera or other video footage or recordings of you.
  • Inferences based on Personal Information. This includes information in performance reviews, any testing you may have undertaken, information related to succession planning, as well as predictive analytics related to your use of Kforce systems and networks.
  • Internet or other similar network activity. The activity you have while connected to Kforce or client systems, including information accessed from your personal device, from email to web browsing, may be collected and used. This includes log-in details, software application usage, VoIP phone usage, and file share access.
  • Non-public education information. This is information related to your academic credentials such as what school you went to, what your GPA was, what activities or sports you did in school, or other data on your school transcripts.
  • Professional or employment-related information. This is all the data related to your employment or engagement with Kforce, including but not limited to Personal Information related to individuals who receive benefits from Kforce because of your status as a worker with Kforce. For example, it can include “right to work” documents, payroll and benefits data, medical leave data, or other kinds of information necessary for Kforce to acquire, manage, and retain talent in its workforce.
  • Sensitive Personal Information. This includes data like financial account numbers, government issued IDs, medical data, etc. collected for business purposes, including background checks and identity verification, and precise geolocation information.
  • Sensory data. This is data which may or may not be related to you directly, as it is usually data coming from devices like security motion detectors or similar devices. However, if it is tied to other data, like key card access logs, it can become personal information.

Kforce uses the information we collect for the following purposes: (1) to recruit workforce members and process employment applications, including verifying eligibility for employment and conducting background and related checks; (2) to fulfill or meet the reason you provided the information, such as processing payroll, administering benefits, or managing vacation requests; (3) to determine eligibility for initial employment, including verifying eligibility to work, carrying out background checks or criminal records checks (where permitted under applicable law), and obtaining professional and personal references during the hiring process; (4) to evaluate an individual’s appropriateness for hire, promotion, or transfer to a new position and to conduct employee onboarding; (5) to place workers with Kforce’s clients for temporary or permanent assignments, including sharing relevant employment-related information with clients as necessary to facilitate placement and ongoing work assignments; (6) to maintain and administer payroll and employee benefits plans, including enrollment and claims handling for workers assigned to clients; (7) to maintain personnel records and comply with record retention requirements; (8) to comply with applicable state and federal labor, employment, tax, benefits, workers’ compensation, disability, equal employment opportunity, workplace safety, and related laws; (9) to provide, support, personalize, manage, administer, and develop Kforce’s workforce and facilitate workforce management for Kforce’s clients; (10) to design, implement, and promote Kforce’s diversity and inclusion programs and health and wellness programs, including any applicable client-specific initiatives; (11) to conduct internal and external audits, investigations, or evaluations, including disclosures made in an effort to prevent or halt alleged violations of Kforce’s policies, illegal activities, or as required by law; (12) to provide you with support and to respond to your inquiries and/or respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; (13) to comply with legal, regulatory, and administrative obligations related to employment, including obligations arising from Kforce’s role as an employment agency placing workers with clients; (14) to defend against or prevent liability to third parties, including claims arising from employment placements; and (15) to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

Kforce may contact you via artificial voice through a third-party service provider regarding employment opportunities. Candidates are free to opt out of the artificial voice communication at any time.

Kforce obtains Personal Information from the following sources:

  • Directly from you. For example, from forms you complete or products and services you purchase (if
    any).
  • Indirectly from you. For example, from observing your actions as an applicant or employee, from
    records of your use of Kforce or client IT systems, or from location-tracking enabled devices.
  • From independent third parties related to your eligibility for employment, or our ongoing management
    of our business.
  • Other Kforce employees, as part of Kforce’s management, evaluation, training, and discipline
    processes.

How We May Share Your Information Based on Your Application or Employment

We may share your personal information with our other employees, contractors, consultants, and other parties (including our affiliates, offices outside of California, and related entities) for a business purpose. A business purpose means the use of personal information for Kforce’s operational purposes or business needs that are reasonably necessary and proportionate to achieve the purpose for which information was collected.

We may share your Personal Information in the following circumstances:

  • With Clients for Employment Placement and Workforce Management – As an employment agency, we may share your Personal Information with Kforce’s clients when facilitating your placement for a job assignment. This may include sharing relevant employment-related information such as your resume, work history, background check status, compliance documentation, and other necessary details for onboarding, workforce management, or contractual obligations between Kforce and its clients.
  • For Legal Obligation or Safety Reasons – When we have a good faith belief that access, use, preservation or disclosure of Personal Information is reasonably necessary to (a) satisfy or comply with any requirement of law, regulation, legal process, or enforceable governmental request, (b) enforce or investigate a potential violation of our policies and procedures, (c) detect, prevent, or otherwise respond to fraud, security or technical concerns, (d) support auditing and compliance functions, or (e) protect the rights, property, or safety of Kforce, its users, or the public against harm.
  • In the Case of a Merger or Sale – If and when we are involved in a merger, acquisition, or any form of transfer or sale of some or all of its business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, Personal Information may be transferred along with the business. Where legally required we will give you prior notice and if you have a legal right to do so, an opportunity to object to this transfer.
  • With Service Providers and Contractors – When we hire a service provider to help operate our business, we may give access to Personal Information as necessary to perform the service for Kforce. This includes collecting Personal Information about you for the purposes described in this Notice. When we share personal information with such parties for a business purpose, we typically enter into a contract that describes the purpose and require that they only use or disclose such personal information in a manner consistent with the use and disclosure provisions of this Notice and our online Privacy Policy.
  • Affiliates – We may share your Personal Information with our affiliates, offices outside of California, and related entities for purposes consistent with this Notice.
  • Professional Advisors – We may disclose your Personal Information to professional advisors, such as lawyers, bankers, auditors, and insurers, where necessary in the course of the professional services that they render to us.

Further, your Personal Information may be disclosed:

  • as permitted or required by applicable law or regulatory requirements. In such a case, we will endeavor to not disclose more personal information than is required under the circumstances;
  • to comply with valid legal processes such as search warrants, subpoenas, or court orders;
  • as part of Kforce's regular reporting activities to other members of the Kforce Affiliates (including outside of your home jurisdiction);
  • to protect the rights and property of Kforce;
  • during emergency situations or where necessary to protect the safety of a person or group of persons;or
  • with your consent.

Disclosures of Personal Information Collected During the Application and Employment Processes

In the preceding twelve months, Kforce has disclosed some or all of the categories of Personal Information as noted above, for the business purposes described above.

Sale and Sharing of Personal Information Collected During the Application and Employment Processes

In the preceding twelve months, Kforce has not engaged in activities constituting the sale, lease, exchange, or disclosure of Personal Information to a third party for monetary or other valuable consideration, except as permitted by law. Kforce does not and will not sell personal information subject to your job application or employment.

Retention of Personal Information Collected During the Application and Employment Processes

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, accounting, or reporting requirements, or as necessary to resolve disputes. In determining how long we retain your Personal Information, we take into account our Records Retention Policy, legal and regulatory obligations (such as legal requirements to retain your information, financial reporting obligations, and equal opportunity or anti-discrimination reporting obligations), the nature and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of the Personal Information, and whether we may need to retain the Personal Information to resolve disputes, make and defend legal claims, conduct audits, pursue legitimate business purposes and/or enforce our agreements.

Under some circumstances we may anonymize your Personal Information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

If you are offered and accept employment with Kforce, the Personal Information we collected during the application and recruitment process will become part of your employment record and we may use it in connection with your employment.

  • Transactional Data. This includes data you may share with us when you are acting in your capacity as a consumer instead of an associate. For example, when you buy our products or services.

Kforce uses the information we collect for the following purposes: (1) to provide you with information regarding employment opportunities and career-related information; (2) establishing and maintaining communications with you; (3) where you have requested a service, assisting you in the completion of your application, the assessment of your eligibility for any such requested service, the processing and maintenance of the service, as well as any applicable renewal of such service; (4) responding to your inquiries about accounts and other services; (5) making proposals for future service needs; (6) allowing our affiliated companies to notify you of certain products or services offered by our affiliated companies; (7) processing transactions through service providers; (8) complying with applicable legal requirements, court orders, legal proceedings, document requests, and industry standards and our policies; (9) protecting against fraud, suspicious or other illegal activities; (10) protecting the rights and business of Kforce or other third-parties including, but not limited to, Kforce’s clients; (11) compiling statistics for analysis regarding our sites and our business; and (12) for training and quality control purposes. Kforce may contact you via artificial voice through a third-party service provider regarding employment opportunities. Candidates are free to opt out of the artificial voice communication at any time.

Kforce obtains Personal Information from the following sources:

  • Directly from you. For example, from forms you complete or products and services you purchase or utilize (if any).
  • Indirectly from you. For example, from records of your use of our website, network, or other technology systems.
  • Third-Party Sources. For example, from independent third parties for our ongoing management of our business.

When you use our website and applications, we use automated means of collecting information, such as cookies and other web-based or electronic tracking technologies to collect information about your use of the website or application. This information is necessary for us to provide you with personalized and location-based content, as well as for analyzing the use of resources, troubleshooting problems, preventing fraud, and improving our services. Collected items may include the pages most frequently visited, services accessed the most, and links to other sites that users most often visit. We measure activity in aggregate, such as number of users of our website, and activities conducted on our website, but may sometimes choose to measure use on an individual level. This allows us to provide a better user experience.

This website also uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help the website analyze how users use the site. The site also utilizes website analytics if your device has local files from Meta products, including Facebook and Instagram, that you have chosen to install separately. Information generated by cookie or web beacon activity that is shared with Meta is subject to your separate agreement and permissions you control with Meta, including past and future choices to share information voluntarily with Meta. For Google Analytics, information generated by cookies about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity, and providing other services relating to website activity and internet usage for Kforce and its affiliates. Both the Google Analytics or the Meta application information could potentially include collection and transfer of your video viewing activity based on your interaction with content on our website. Kforce’s use of third parties related to the videos on our website is limited to service providers who are under contract with Kforce to support the posting and viewing of video content on the website. Google and/or Meta may also transfer this information to third parties where required to do so by law, or where such third parties process the information on their behalf. You may refuse the use of cookies by selecting your preferences in the cookie banner on the website or selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of this website. You may also disable or change the processing of data about you by Meta through changes in your settings on the Meta site and/or your interactions with Meta products you have chosen to install on your device or browsers. By using this website, you consent to the processing of data about you in the manner and for the purposes set out above.

How We May Share Your Information Based on Your Usage of Our Website

Kforce may disclose your Personal Information: (1) to third parties to perform business functions; (2) to our affiliated entities for the purposes of providing marketing, or improving our services; (3) to comply with legal requirements, such as a law, regulation, search warrant, subpoena or court order; (4) as part of a business transaction, such as a reorganization, merger, acquisition, bankruptcy, or similar event, or (5) in special cases, such as protecting the rights, property, or safety of Kforce, our customers or others.

Kforce may share your Personal Information with third-parties or Kforce customers or potential customers for employment, recruitment, and placement services for your potential employment opportunities with customers who are seeking employees who have your qualifications, or to a customer with whom you have been placed by Kforce, to integrate with their employment or application process, or for their reporting or analytics requirements. Kforce may also share your information with third-party service providers and affiliates who may contact you on our behalf. These service providers and/or affiliates will not contact you for marketing/promotional purposes unrelated to the purposes outlined above. These service providers will have agreements with Kforce to handle your Personal Information the same way Kforce would. For example, Kforce uses analytics providers which track your use of the website or application. Kforce will only share Personal Information about you that is relevant to our legitimate business purposes or as stated in this Privacy Policy and reasonably related to the purposes for which you have provided your information.

Additionally, this website uses the Google AdWords remarketing service to advertise on third-party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven’t completed a task on our site, for example using the contact form to make an inquiry. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to the Kforce website. Of course, any data collected will be used in accordance with this Privacy Policy and Google’s privacy policy.

Linked Websites

Kforce’s website contains links to third-party websites not controlled by Kforce and therefore not covered by this Privacy Policy. Any information that you submit, post, or otherwise reveal on these third-party sites is governed by the privacy policy of those sites. We recommend that you review the terms and conditions of use and privacy policies in place on such third-party websites.

Protecting Your Information

We want your information to remain as secure as reasonably possible. We regularly monitor industry standard technical safeguards for securing your Personal Information and review our physical, technical, and organizational security practices to determine how we can prevent the loss, misuse, unauthorized access, alteration, or disclosure of your Personal Information. While we strive to protect your Personal Information, considering the nature of the Internet, and your control over your own access codes, Kforce cannot ensure or warrant the complete security of any information you transmit to us.

Your Communication Choices

We may also, from time to time, use your Personal Information to send you informational communications or marketing materials regarding our services, including employment information and job opportunities that you indicate an interest in, where you have experience or when creating a profile. You may receive these messages from Kforce or its service providers via email, phone, text, direct mail, and other communication means.

We do not, however, want to send you information that you do not wish to receive, and you may opt out of receiving these communications or change your preferences, as indicated below:

  1. Unsubscribe/Opt-Out. Each communication we send that contains marketing communications will contain instructions on how to unsubscribe or opt-out if you do not wish to receive these types of communications in the future from Kforce.
  2. Direct Request. You can email us directly to request to be removed from communications by sending the request to privacy@kforce.com.
  3. Update Profile Online. You can access your profile online via the website, or the application, and change your communication preferences or unsubscribe from informational communications.

Note that if you choose to communicate with Kforce via text messaging the frequency may vary, and message and data rates may apply. Carriers are not liable for delayed or undelivered messages. You will always have the right to cease communicating via text by using key words such as STOP.

You may choose to personalize or opt-out of cookies. Simply refer to the “What Information We Collect and How that Information May Be Used” section above or your browser’s help instructions to learn more about how to manage their use.

Most internet browsers allow you to remove or manage cookie functions and adjust your privacy and security preferences. Outside of the use of the cookie settings in your browser, there are also browser-specific settings like “Do Not Track” (“DNT”) or “Global Privacy Control” (“GPC”). Because the DNT signal is not widely adopted and is not a finalized standard, we don’t respond to DNT signals. However, GPC signals are generally recognized and if you have made these elections nothing further needs to be done as a result of a GPC signal.

Your California Privacy Rights

This section only applies to individuals who are residents of California and protected under the California Consumer Privacy Act of 2018 (“CCPA”), as amended, and other California privacy laws (together “California Laws”).

a. Personal Information Collected and Disclosed to Third Parties

The section above titled “What Information We Collect and How that Information May Be Collected and Used" identifies the categories of Personal Information, as defined by California Laws, that Kforce has collected in the last twelve months, as well as the methods, sources, or ways we collect Personal Information.

We describe how we have disclosed this Personal Information in the last twelve months in the section titled, “How We May Share Your Information” above. In addition to this information, in the last twelve months, Kforce has disclosed, “shared,” or “sold” the following categories of Personal Information to the following categories of service providers and third parties.

b. California Residents Rights

Under California Laws, California residents have the following rights (“Rights”) listed below. Your Right to Access, Right to Deletion, and Right to Correct are not absolute and are subject to certain exceptions.
For instance, we cannot disclose specific pieces of Personal Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personal Information of yours or others, your account with us or the security of the business’s systems of networks. There are also exceptions to deletion requests if the information is necessary to complete a transaction, for internal uses aligned with expectations, compliance, and legal obligations, or for other internal purposes in a lawful manner compatible with the context in which the consumer provided it.

You Have the Following Rights Under California Laws

  • Right to Know. You may request Kforce to provide you the specific pieces of Personal Information that we have about you, categories of Personal Information we have collected about you, categories of sources from which the Personal Information is collected, categories of Personal Information that we may have sold or disclosed for a business purpose about you, categories of third parties to whom the Personal Information may have been sold or disclosed for a business purpose, and the business or commercial purpose for collecting or selling Personal Information. Please note that much of the information for which you can make a request is already contained in this Policy. Should you wish to exercise this right, please contact us via one of the methods noted below under “Exercising California Privacy Rights.” If necessary, we may ask for some Personal Information in order to verify your identity and to confirm your rights related to your request.
  • Right to Delete. California law gives residents a limited right to request deletion of their Personal Information. However, this right is limited by a number of exceptions. Fundamentally, if we have a permissible need to retain Personal Information, we are not under an obligation to delete such information, even when requested. Generally, we retain Personal Information so we may fulfill or accomplish the purposes for which the Personal Information was collected, provide information or a service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you; detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity; debug to identify and repair errors that impair existing intended functionality of our online properties; enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us; comply with a legal obligation; or otherwise use your Personal Information, internally, in a lawful manner that is compatible with the context in which the information was collected. We will respond to requests to remove Personal Information from some of our system within reason and as required to by law. If you would like to request deletion of Personal Information, please contact us via one of the methods noted below under “Exercising California Privacy Rights.” We may ask for some Personal Information in order to verify your identity and to confirm your rights related to your request.
  • Right to Correct. If Kforce maintains any inaccurate Personal Information about you, you may request Kforce correct your Personal Information.
  • Right to Opt-Out. You may request to opt out of the sale or sharing of your Personal Information by Kforce.
  • Right to Limit. You may request Kforce limit the sharing of your Sensitive Personal Information.
  • Designating an Authorized Agent. California law permits California residents to designate an agent to manage their rights under California law. If you would like to designate an agent to manage your privacy preferences, you may do so using the mechanisms noted below under “Exercising California Privacy Rights.” We may ask for some Personal Information in order to verify your identity and to confirm your rights related to your request. We will also need sufficient Personal Information about your authorized agent to be able to identify them. As part of this process, you must have permission from your authorized agent to disclose their Personal Information to us for the purpose of acting as your agent.
  • Non-discrimination. California law does not permit us to discriminate against you because you exercised any your rights under this title, including, but not limited to, by: denying you access to goods or services; charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; providing a different level or quality of goods or services; or suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Exercising California Privacy Rights

Californians can exercise their privacy rights by submitting a request via the Privacy Rights webform, contacting us at privacy@kforce.com or via the other avenues outlined in the below section titled, “How to Contact Kforce”. In some cases, we may need to collect additional information to verify your identity, such as your name and proof of residence. We will use the information provided in connection with a request solely for the purposes of verification. We cannot effectuate your request if we are unable to verify your identity or authority to make the request and confirm that the Personal Information relates to you.

Californians may exercise these rights themselves or they may designate an authorized agent to make these requests on their behalf. If we receive a request from an authorized agent, we may take steps to verify their ability to act on the consumer’s behalf, including through contacting the consumer. In most cases, we will facilitate a rights request through automated tools available on our website or through your password protected account.

Kforce does not discriminate against any individual for exercising their privacy rights as we know and understand how important your Personal Information is to you, and hope you understand we are also committed to ensuring the most reasonably feasibly and available protections of your Personal Information. We will handle requests as required under applicable California Laws. When a request is made, we may verify your identity to protect your privacy and security and will respond via the options stated above. Please note that we are only required to respond to each customer twice per calendar year.

Retention of Your Personal Information

Kforce will retain your Personal Information for as long as required to provide the services or complete the transactions for which your Personal Information was collected. Kforce will also retain data for as long as legally required or allowed to do so for compliance obligations, dispute resolutions and by the schedule in the Kforce Records Retention Policy.

Changes to Privacy Policy

Kforce may change this Privacy Policy from time to time due to changes in relevant law or Kforce’s business practices, but in the least we will review this policy annually. If we decide to make changes to this Privacy Policy, we will post the changes on this website, and your continued usage after such changes are posted constitutes acceptance of each revised Privacy Policy.
